Dear Sir or Madam ,
Please allow this to serve as formal request under RSMO Chapter 610 for records of 911 calls regarding the incident as well as the incident report as defined in Chapter 610.150: “information consisting of the date, time, specific location and immediate facts and circumstances surrounding the initial report of the crime or incident shall be considered to be an incident report.”
I am requesting 911 calls, 911 tapes, surveillance video and all evidence obtain on January 3, 2020. I believe RSMO 610.100 also allows me, as the attorney of the party involved Rhonda Watts, to obtain the actual recordings of the 911 calls. See RSMO610.100.4:
“Any person, including a family member of such person with the first degree of consanguinity if such person is deceased or incompetent, attorney for a person, or insurer of a person involved in any incident or whose property is involved in an incident, may obtain any records closed pursuant to this section or section 610.150 for purposes of investigation of any civil claim or defense.”
These record are due within 30 days per RSMO 610.150.4. I am requesting them for the purpose of investigation of a civil claim, I look forward to your cooperation and production of the tapes as well as the incident report within the legally allotted time period.
